The Kentucky County Clerks Association has formally adopted the Property Records Industry Association (PRIA) standards for Real Estate Document Formattingas of January 1, 2020.

Standards are as follows:

Paperweight: 20 lb
Paper size: 8 1/2 x 11 preferred
8 1/2 x 14 accepted
Paper color: White; no watermarks
Staples or binding: None
One or two side print: One side only
Impression seals: None allowed
Colored highlight markers: None allowed
Margins: Top 3″ of the first page recommended for Recorder use, especially on right side of the page
All other margins 1″
Ink color: Black preferred, with dark blue signatures
Font: 10-point Times New Roman or equivalent
Spacing: 9 lines per inch maximum

Accessing Records Online:

Commercial User Records Search: This site was developed for businesses and individuals that are in the business of researching documents. There is a subscription fee and you will also have the option to add other counties within your searchable area.

Private Citizen Records Search: This site is for Union County residents seeking to search for personal reasons with zero commercial gain. You may only search Union County records and are limited to five searches per day. No charge for this service.

Monthly Subscription Costs

  • $65 per month, per county
  • $20 one time setup fee for additional counties
  • $10 per additional user

Single Day Subscription Costs

  • $45 one time setup fee for the first county
  • $15 one time setup fee for additional counties
  • $10 per additional user

Legal Recording Fees

One of the most important responsibilities of the County Clerk’s office is the recording of land records. Recorded instruments date back to 1811. The most common documents recorded are deeds, mortgages, assignments, and mortgage releases. All land records are available for public viewing at our office located at 100 W Main St, Morganfield, Kentucky 42437.

There are some changes that the Union County Clerk’s office is making in 2022. Soon we will be offering E-Filing in which you may have your records recorded, electronically. This service will allow you to send documents to the clerk’s office without having to send them via mail, FedEx, UPS, or hand-delivery. The E-filing service is expected to be available in January 2022. To learn more about this service, please contact our office at 270-389-1334.

Notary

A notary public is an official of the Commonwealth of Kentucky appointed to take acknowledgments, administer oaths and affirmations, take verifications, certify that a copy of a document is a true copy, certify depositions, protest negotiable instruments, witness or attest signatures, and perform other notarial acts authorized by Kentucky Revised Statute. A notary public may also certify that a tangible copy of an electronic record is an accurate copy of the electronic record if the notary has taken reasonable steps to confirm the accuracy of that certification.

Notary Public State at Large

A notary public, state at large, is a resident or non-resident of Kentucky who is appointed by the Secretary of State under KRS 423.390 to perform notarial acts within the state of Kentucky.

An applicant for a commission as a notary public, state at large, must:

  • Be at least eighteen years of age;
  • Be a citizen or permanent legal resident of the United States;
  • Be a resident of, or have a place of employment or practice in the Kentucky county where the application is made;
  • Be able to read and write English; and not disqualified under KRS 423.395.

An applicant may be denied appointment as a notary public, state at large, for:

  • Failure to comply with Kentucky notary laws;
  • Fraud, deceit or omission on the notary application;
  • Conviction of any felony or a crime involving fraud, dishonesty, or deceit;
  • Failure to discharge the duties of a notary imposed by statute or administrative regulation;
  • Use of false or misleading advertising;
  • Representing that the notary has a right, duty or privilege that the notary does not have;
  • Denial, refusal to renew, revocation, or suspension of a notary commission in another state; or
  • Failure to maintain notary surety.

To apply for a Kentucky Notary Public State at Large appointment or reappointment, download the application from http://web.sos.ky.gov/notaries/NotaryPublic and submit it online, or mail it with a $10.00 fee made payable to Kentucky State Treasurer to:

Once the application has been approved by the Office of the Secretary of State, a written notice will be sent to you stating that you must complete your appointment within 30 days of receipt of that notice by taking the oath of office and providing $1,000 surety at the County Clerk’s Office.

Marriage License

Marriage licenses are issued in the County Clerk’s office. Both parties must appear together. The license is valid for 30 days from the date of issuance and the license fee is non-refundable. The license must be used within the State of Kentucky.

Age Requirements

You must be 18 years of age to be married in Kentucky.

Procedures

No waiting period or blood test is required prior to issuance of a marriage license. In Kentucky, both parties must be present to sign & swear to the information on the application.

Information Required:

  • Name and Address
  • Date of Birth and Current Age
  • Place of Birth (if in Kentucky, provide name of county; in another state, provide name of state)
  • Father’s Name
  • Mother’s First and Maiden Name
  • Current Status of each party (Single, Divorced, Annulled, Widowed)
  • Number of previous marriages of each party 
  • Occupations of each party
  • Race of each party
  • Whether the parties are related (First & Second cousins are NOT permitted to marry in Kentucky)
  • Date of Marriage

You may view and print a copy of the marriage application and complete prior to coming to the clerk’s office.  Application must be signed & sworn before the county clerk issuing the license.
